1. Overview

Tochan AI ("we," "us," or "the Provider") operates a chat support platform that makes publicly available information from educational institutions — including schools' websites and knowledge base documents — accessible to students, parents, staff, and other authorized users via an embeddable chat interface.

This Privacy Policy describes how we collect, use, and protect information in connection with our platform and governs our relationship with partner institutions ("Clients"). By entering into a service agreement with Tochan AI, Clients acknowledge and agree to the practices described herein.


2. No Collection of Personally Identifiable Information

Tochan AI's platform is not designed to collect, store, share, process, or output personally identifiable information ("PII"). The platform is intended solely to surface publicly available information provided by the Client.

Client responsibility: Clients must ensure that their users — including students, parents, and staff — are not inputting sensitive or personally identifiable information into the chat interface. Tochan AI is not responsible for any PII that a user voluntarily submits through the chat widget in violation of its intended use.

As no PII is intentionally collected or processed, this service is not subject to FERPA compliance obligations.


3. Information We Do Process

While we do not collect PII, the platform does process the following in order to function:

- User queries: Text entered into the chat interface is processed in real time to generate a relevant response. Queries are routed through our backend service providers (see Section 5) and are not stored by Tochan AI on a persistent basis for identification purposes.
- Client-provided knowledge base content: Documents, website content, and other materials submitted by the Client for use in the platform. This content remains the intellectual property of the Client and is used solely to power responses within that Client's deployment.
- Usage and session data: We may collect anonymized, non-identifiable technical data (such as query volume and response performance) for the purposes of service monitoring, quality assurance, and improvement.


4. How We Use Information

Information processed through the platform is used exclusively to:

- Deliver accurate, relevant responses to end users based on the Client's publicly available content
- Monitor and maintain platform performance and uptime
- Improve the quality and reliability of the service

We do not sell, rent, or share any data with third parties for marketing or advertising purposes.


5. Third-Party Service Providers

Tochan AI uses the following third-party services in the delivery of its platform. By engaging Tochan AI's services, Clients acknowledge that queries and knowledge base content may be processed by these providers:

- Voiceflow — Used to design, deploy, and manage conversational flows on the backend. Voiceflow processes user queries as part of the chat interaction pipeline.
- Anthropic (Claude) — An AI language model used to generate responses. User queries and relevant knowledge base context are sent to Anthropic's API for response generation.

Both providers operate under their own privacy and data processing policies. Tochan AI selects and works with providers who maintain commercially reasonable data security standards. Tochan AI is not responsible for the independent data practices of these third parties, and Clients are encouraged to review their policies directly.


6. Data Security

Tochan AI implements commercially reasonable technical and organizational measures to protect information processed through the platform. However, no method of electronic transmission or storage is completely secure. Given that the platform is not intended to handle sensitive or personally identifiable data, Clients are reminded that the most effective protection is ensuring such data is never entered into the system.


7. Termination

Either party may terminate their service agreement with Tochan AI in writing at any time prior to the next renewal date. Refunds will be considered on a case-by-case basis.

Upon termination, Tochan AI will cease serving the Client's deployment. Knowledge base materials will be removed upon written request.


8. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will notify active Clients of material changes by posting the updated policy on our website and updating the effective date above. Continued use of the platform after such changes constitutes acceptance of the updated policy.
